Gift Card Terms & Conditions

  1. The following terms and conditions (“Terms“) apply where you purchase, receive, activate, use or contribute to an Anue Gift Card (“Gift Card“) or e-Gift Card (“e-Gift Card“).
  2. If you allow another person to use or take possession of your Gift Card or e-Gift Card, you must tell that person that the use of the Gift Card or e-Gift Card will be bound by these Terms.
  3. Anue Gift Cards are issued by Anue Limited (“Anue”) and are redeemable for merchandise or services at clinics owned or managed by Anue.
  4. Anue reserves the right to correct any errors in the issuing of a Gift Card or e-Gift Card. We will endeavour to correct any error as quickly as possible.
  5. Anue reserves the right to refuse to issue a Gift Card or e-Gift Card to any person or entity or to suspend or cancel any Gift Card or e-Gift Card for any reason, at any time, without notice. If this occurs, the balance on all valid Gift Cards or e-Gift Cards will be refunded to the holder on presentation of the Gift Card or e-Gift Card.
  6. Anue may vary these Terms from time to time by posting revised Terms on our website. If you already have a valid Gift Card or e-Gift Card and you are do not accept any changes to the Terms, then the Gift Card or e-Gift Card balance will be refunded upon request as this request is made prior to the expiry of the Gift Card or e-Gift Card.
  7. Your Gift Card may not be copied or reproduced in any circumstances.
  8. These Terms are governed by and construed in accordance with the laws of New Zealand.
  9. Subject to any rights you may have at law, including under the Consumer Guarantees Act, all e-Gift Cards are sold on a no refund, exchange or cancellation basis.
  10. Gift Cards may not be used for any other purpose.  Purchase with a Gift Card is as if the purchase was made by way of cash payment. Gift Cards may not be redeemed for cash. They are not legal tender, account cards, credit or debit cards or securities.
  11. A single Gift Card can be loaded with a minimum value of $10 and a maximum value of $1,000.
  12. We cannot sell more than $4,999 of gift cards to any individual, company or other legal entity within any 3 month period.  We also cannot split a bulk order exceeding $4,999 of gift cards into multiple smaller orders, even where those smaller orders may be spread over a timeframe longer than 3 months. It is our sole discretion as to whether a series of transactions are related.
  13. When purchasing online, you represent and warrant that you will not exceed the maximum purchasing limit and agree that Anue may cancel any online purchase or void any Physical Gift Card or e-Gift Card that breaches this limit.
  14. Gift Cards are only available for delivery to a residential or business address within New Zealand. They cannot be delivered to a P.O. Box.
  15. If there any issues regarding the delivery of a Gift Card, Anue should be notified.
  16. To the extent permitted by law, we will not be liable to you or anyone else for any losses suffered or incurred due to delay in delivery or for lost or misdirected Gift Cards including where the incorrect delivery address address is provided at the time of purchase.
  17. Subject to payment, property and risk in the Gift Card passes to you upon receipt and activation of the Gift Card.
  18. Gift Card credit will expire 24 months from issue date. After expiry, the Gift Card is no longer valid. All transactions will be declined and any outstanding balance will be forfeited to Anue.
  19. Gift Cards should be held in a secure place, as any person holding the Gift Card may be able to use it to make purchases.
  20. Lost or stolen Gift Cards will not be replaced. Any unused balance left on expiry will not be refunded.
  21. Gift Cards will be void and will not be redeemable if they are defaced, mutilated, altered or tampered with in any way.
  22. The bearer of a Gift Card may not consolidate the balances of several Gift Cards onto a new Gift Card.
  23. A Gift Card has no value unless activated in Anue’s Systems and payment has been made to Anue. Anue’s Systems will be conclusive evidence of the balance, transaction history and expiry date of a Gift Card. No statements or transaction history will be sent to the bearer of the Gift Card.
  24. A Gift Card can be redeemed in whole or for part payment of goods and services. No change will be given and any balance on the Gift Card may be used for future purchases. Gift Cards can only be used to make purchases up to the initial Gift Card amount, or the remaining balance. If the purchase price exceeds the balance of the Gift Card, the bearer must pay the difference using another payment method.
  25. Gift Cards can be used in conjunction with another form of payment, such as credit card or cash, to make up the full value of the purchase.
  26. Once a Gift Card has reached a zero balance it cannot be reloaded or re-activated.
